1. Scope and acceptance

This website is operated by Daryna Klekh, 27 Ushynskoho Street, Kyiv 03151, Ukraine (“we”, “us”). By using the website you agree to these terms. The interest list is covered separately by the Terms and Conditions, and personal data by the Privacy Policy and Cookie Policy.

2. An informational website

The website describes a resort that is planned but not built. It does not take reservations, sell goods or services, process payments or create any contract for accommodation. Nothing on it is an offer, and nothing on it should be read as a statement that the resort operates.

3. Accuracy of content

We try to keep the information accurate and up to date, but details of the project are plans and may change. Images are artist’s impressions. Room areas, capacities, facilities and other figures are design targets. Seasonal conditions, the canal timetable and the gaming lounge, which is subject to licensing, are not guaranteed.

4. Intellectual property

The text, artist’s impressions, design, layout and graphics of this website, and the name and monogram of Fjellro, are owned by or licensed to the website owner and are protected by copyright and other intellectual property laws.

You may view and print pages and share links to them for personal, non-commercial purposes. Any other copying, reproduction, adaptation or commercial use requires our prior written permission. For press or partnership requests, please write to [email protected].

The typefaces Syne and Commissioner are used under the SIL Open Font License 1.1; the licence text is included with the website files.

5. Third-party names and marks

Names such as Aria Resort & Casino, Grand Portage Resort, Norsk Tipping, Norsk Rikstoto and Hjelpelinjen belong to their respective owners. They are mentioned for information or editorial comparison only. Their mention does not imply any connection, sponsorship or endorsement, and Fjellro has no affiliation with any of them.

6. Acceptable use

When using the website you agree not to:

• use it in any way that breaks the law or infringes the rights of others;
• try to gain unauthorised access to the website, its server or related systems, or interfere with their security or operation;
• place excessive load on the website, including through automated scraping or high-volume requests;
• collect the email addresses published on the website to send unsolicited messages;
• pretend to be us, or present any content as coming from Fjellro when it does not;
• introduce viruses, malicious code or other harmful material.

We may block access from sources that breach these rules.

7. Using the interest list form

The interest list form on the contact page does not submit anything to our server. It checks your entries in your browser and then opens your own email app with a prepared message. Nothing is sent until you press send in your email app. You are responsible for the content of any message you send, and you can edit or delete the prepared text before sending it.

If your device has no email app configured, the button may do nothing visible. In that case you can write to us directly at the address shown under the form.

8. Messages you send us

When you email us, please do not send confidential information you would not want stored in an ordinary mailbox, and do not send documents, payment details or identity numbers: we do not need them and will not ask for them. We may decide not to answer messages that are abusive, unlawful or clearly unrelated to the project.

9. Security of the website

The website is built to load only its own files and to block content from other sources. We keep it simple on purpose: there are no user accounts, no passwords and no payment forms. If you believe you have found a security weakness, please report it to [email protected] and give us reasonable time to fix it before disclosing it publicly.

10. Accessibility

We aim to make the website usable for as many people as possible, including keyboard and screen reader users, and to respect reduced-motion settings. If something does not work well for you, please tell us at [email protected] and we will try to improve it.

11. Links to other websites

The website contains a small number of links to other websites, such as Hjelpelinjen and supervisory authorities. We do not control those sites and are not responsible for their content or privacy practices.

12. Availability and changes

We may change, suspend or withdraw the website or any part of it at any time, for example as the project develops. We do not guarantee that the website will always be available or free from errors.

13. Age

The website describes a resort that includes a gaming lounge subject to licensing and is intended for adults aged 18 and over.

14. Disclaimer

To the extent permitted by law, the website and its content are provided “as is”, without warranties of any kind, whether express or implied, including warranties of accuracy, completeness or fitness for a particular purpose.

15. Limitation of liability

To the extent permitted by law, we are not liable for any loss or damage arising from the use of, or inability to use, the website or from reliance on its content, including decisions about travel or purchases made on the basis of plans for a resort that does not yet exist.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, for gross negligence or intent, or your mandatory rights as a consumer.

16. Governing law

These terms are governed by the laws of Ukraine. If you are a consumer habitually resident in Norway or another EEA country, you keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts of that country.

17. Changes to these terms

We may update these terms from time to time. The date at the top shows the current version. By continuing to use the website after a change, you accept the updated terms.

18. General provisions

If any part of these terms is found invalid or unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of our right to do so later. These terms, together with the documents they refer to, are the entire agreement between you and us about the use of this website.
